1- WHO is the CONTROLLER for the processing of your data?

2- WHAT PERSONAL DATA are necessary and may be collected?

Personal Data refers to any information or data that can identify you directly or indirectly, we may collect: your name or surname, your ID, email address, private postal addresses, mobile phone number, usernames, profile pictures, etc. We may collect or receive your data online (email, web form, social networks, etc.).

Obtained from the interested party: The personal data that you provide us with will be incorporated into computerized databases or physical files which, in turn, are subject to security measures and are included in a register of activities owned by Truccsa. The register of processing activities is a list of summary information on the data processing that we carry out and is available to the Spanish Data Protection Agency.

Truccsa does not analyse or use, in any case, external means to our direct relationship with our users. All the inferred data that we may use refers to your interaction with us or with our collaborators and legitimate suppliers.

The personal data that we request from you are necessary to manage your queries, or to fulfil the contractual relationship that we maintain, so if you do not provide them, we will not be able to attend to you. When you provide us with your personal data, you guarantee that you are authorised to provide this information and that it is true, truthful, accurate and up-to-date, that it is not confidential, that it does not violate any contractual restriction or third party rights and that you undertake not to impersonate other Users by using their data for the different services and/or contents of the Website.

Data of third parties. With regard to other people’s data, you must respect their privacy and take special care when communicating or publishing their personal data. Only the owner can authorise the processing of their personal data. If you provide us with data of third parties, it is your responsibility to have their prior and express consent to use and communicate them to us, and it is your responsibility to inform them of the inclusion of their data in our files.

Data of minors. Minors under 14 years of age may access and view the Truccsa, website, but under no circumstances may they provide us with their personal data, for which the authorisation of their parents (both or at least one with the consent of the other), guardians, legal representative or the person they are in charge of will be required. We do not assume any liability in the event that minors provide us with their data in breach of the requirements of this paragraph.

3- Processing of data provided through our WEBSITE

In general, you can visit our website without providing any personal information. The information we ask you for is the minimum necessary for the required action, if you do not answer these sections, we will not be able to deal with your request correctly. Please avoid including confidential or sensitive information in the forms. In case we need any additional information, we will contact you.

Our contact forms include a specific privacy clause that informs the user before obtaining their consent to the automated processing of their data, which Truccsa Truccsa will use exclusively for the purposes reported in each case, the boxes marked with the symbol [*] are mandatory, and their completion implies full and unconditional acceptance of this privacy policy.

  1. “CONTACT”:
  • Purpose:To provide you with a means of contacting us, your data will be processed in order to manage and respond to your query or request, sending the required information and subsequent commercial follow-up.
  • Legitimation:Your express and informed consent when you send us your query, before sending the form you will have to read and check a box to give your informed consent to the processing of your personal data. You may optionally authorise the receipt of commercial information.
  • Retention: for a period of one year after resolving your request or query if it has not generated a new treatment as a customer, and if you have agreed to receive commercial mailings, until you request to unsubscribe from them.

In accordance with the provisions of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, Truccsaundertakes not to send advertising by email without first obtaining the express authorisation of the recipient and/or having another basis for legitimisation.

4- For what PURPOSE and on what LEGAL BASIS are we going to process your personal data?

Truccsa shall process the personal data strictly necessary in relation to the purposes for which they are processed in each case, in accordance with the principles set out in art. 5 of the GDPR and shall provide data subjects, at the time their personal data is obtained, with the information necessary to guarantee fair and transparent processing.

Below, we explain the purposes for which we process your personal data and the legal basis on which we do so. At Truccsa we process your personal data for the following PURPOSES and LEGAL BASES:

I. To manage requests for information and answer queries made through the Web and Email.

In the case of the processing of personal data provided by users of the website or email, the purpose of the collection and automated processing of the data is the management, extension and improvement of the information or service requested and the subsequent commercial monitoring by electronic means of the user’s requests or requirements until they are fully satisfied and fulfilled.

LEGAL BASIS: the data processing has its legal basis in the express consent of the user when contacting us and sending us their queries, art. 6.1.a) of the RGPD.

II. To manage the contractual and commercial relationship with our customers.

Here the processing of data by Truccsa includes the integral management of the contract: management and monitoring of budgets; contractual, administrative and accounting management; sending of electronic communications to inform you about the evolution and development of all the phases of the contract; invoicing and collection management; management of queries, requirements, disputes related to the service provided.

We will not create business profiles on the basis of the information provided and will not make automated decisions about you on the basis of such a business profile.

LEGAL BASIS: the processing of the data has its legal basis in the performance of the respective service contract or in the execution of pre-contractual measures (budget), art. 6.1.b. RGPD: maintenance, fulfilment and development of the contractual relationship between the parties, your personal data being essential for this purpose.

III. To send you commercial information about the services we provide.

In this case, the processing of data by Truccsa includes the sending of commercial communications, improvements and new features of our website.

You may withdraw your consent to receive commercial communications at any time without, in any case, this withdrawal conditioning the processing of data for the rest of the purposes of our commercial or contractual relationship.

LEGAL BASIS: the processing of the data has its legal basis in the express consent of the interested party (users/potential customers) when they tick the box to accept the sending of advertising and based on our legitimate interests in advertising our services, similar to those contracted by our customers: article 21.2 of the LSSI-CE, allows us to send our customers commercial communications to our customers by electronic means.

IV. To manage the contractual relationship with our SUPPLIERS

Truccsa will process the personal data of its Suppliers in order to comply with the obligations acquired by virtue of the respective contractual relationship: administrative, fiscal, accounting and invoicing management. The processing of the data collected by virtue of the provisions herein shall be carried out and shall remain in force for as long as the purpose for which they were collected is maintained and until the expiry of the statute of limitations on liabilities between the parties.

LEGAL BASIS: The processing of personal data of our suppliers has its legal basis in art. 6.1.b) of the RGPD: the execution of a contract to which the supplier is a party or for the application at its request of pre-contractual measures, as well as in compliance with obligations that the General Tax Law and others impose on the parties.

V. To manage the relationship with job applicants

Truccsa is the data controller for the processing of the “Human Resources” activity register, which will include the CVs sent through the website, in order to analyse your professional profile for the purposes of including you in our personnel selection processes and to inform you by post or e-mail of vacancies in our company.

The data provided will not be disclosed or transferred to third parties and their processing is legitimised by your express consent by virtue of your spontaneous application. Your data will be kept until you request their deletion, however, CVs that have not been updated within 2 years will be deleted.

LEGAL BASIS: the legal basis for the processing of curricular information is based on the consent of the interested party when sending us your curriculum, art. 6.1.a) of the RGPD and in the execution of pre-contractual measures art. 6.1.b. RGPD in the case of entering into a recruitment process.

VI. To enable the operation and security of our website through the use of COOKIES.

Truccsa has a legitimate interest in the processing of personal data that is strictly necessary to guarantee the security of the network and of the information, against accidental events or illicit or malicious actions that compromise the availability, authenticity, integrity and confidentiality of the personal data stored or transmitted, and the security of the related services offered by providers of electronic communications networks and services and providers of security technologies and services.

  • Data processing here includes: appropriate display of content; customisation of the interface, such as language; parameters attached to your device such as screen resolution, etc.; improving the website and ensuring that it is safe and secure.

LEGAL BASIS: the processing of data has its legal basis in your consent in the case of analytical cookies and in Truccsa‘s legitimate interest: to ensure that we provide you with a website and applications that work correctly, improve their operation and keep them secure (technical, functional and web security cookies).

5- WHO has access to your personal data?

Truccsa will not transfer your personal data to third parties outside the relationship that links us without the prior informed consent of the user or, unless required by law.

However, in order to provide you with an adequate service, Truccsa has SERVICE PROVIDERS who may process your data, guaranteeing at all times the protection and security of the same by means of the subscription of the corresponding legal contracts, as is the case of data processors who provide us with computer maintenance and security services, web and e-mail hosting and support services, tax consultancy, etc.

All these service providers, as data processors, are limited to accessing or using the data only to provide the specific service contracted and provide us with evidence that they comply with the requirements of the GDPR in terms of data security measures and safeguards.

6- What are YOUR RIGHTS in relation to your personal data?

Interested parties have the following rights:

  1. The right of ACCESS. You have the right to be informed as to whether Truccsa is processing your personal data, what the data are, to access them, to obtain information about the processing carried out and to obtain a copy of them free of charge.
  2. The right of RECTIFICATION. You have the right to request that inaccurate personal data be rectified and incomplete personal data be completed.
  3. The right to ERASURE: you have the right to request the deletion of your data when it is no longer necessary for the purpose for which it was provided or when your data is unlawfully processed.
  4. The right to the LIMITATION of processing: this right has two aspects: you have the right to request Truccsa to suspend the processing of data or that we keep them in the legal cases. You can also request the limitation when you need the data for the formulation, exercise or defence of claims.
  5. The right to data PORTABILITY: where data processing is based on consent or a contract and is carried out by automated means, the data subject has the right to receive the personal data concerning him or her, in a structured, commonly used and machine-readable format, and to transmit them to another data controller.
  6. The right to OBJECT: You may object to the processing of your data when it must cease because of your personal situation or when the purpose of the processing is direct marketing. You may revoke your consent to receive advertising communications at any time by sending an e-mail to administracion@truccsa.com.

We also inform you that, as autonomous and distinct rights from the above, you have the following:

  • The right to withdraw the consent previously given at any time by contacting administracion@truccsa.com.
  • The right to lodge a complaint/complaint with the supervisory authority responsible for data protection, the Spanish Data Protection Agency, www.aepd.es.

The exercise of these rights is free of charge, except in the case of manifestly unfounded or excessive requests, in which case the data subject may be required to bear the cost of processing the request.

7- For how long will your data BE PROCESSED?

The European Regulation 2016/679 of 27 April, establishes the “Principle of Time Limitation”, in its Article 5(e): “personal data shall be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes of the processing.

In general, your data will only be kept for the time strictly necessary for the purpose for which they were collected, until the owner objects to the processing and in any case until the prescription of legal obligations.

  • Data obtained from users in web consultations: For a period of 1 year, unless they give rise to new processing as a customer and, without prejudice to the data subject’s right to exercise his or her right to erasure beforehand.
  • With regard to the processing of data for advertising purposes: the personal data of data subjects will be processed indefinitely as long as the data subject does not request deletion. Art. 6.1.a) RGPD.
  • Fiscal, tax and commercial data: They will be kept for the period of time established by fiscal and tax regulations, or other applicable regulations.
  • The data collected for the formalisation and execution of the contract, once it has been fulfilled, will be kept for the period of time established by tax, fiscal, commercial legislation, etc., as well as the time necessary for the formulation, exercise or defence of claims and the prescription of liability actions that may arise between the parties.

8- SECRET AND SECURITY of your data

Truccsa guarantees that we will treat your data in strict confidentiality in accordance with data protection regulations. Once we receive your data, we use strict security procedures and functions to: guarantee the confidentiality, integrity, availability and permanent resilience of the processing systems and services; restore the availability and access to personal data quickly in the event of a physical or technical incident; verify, evaluate and assess, on a regular basis, the effectiveness of the technical and organisational measures implemented to guarantee the security of the processing and to pseudonymise and encrypt personal data, where applicable.

This website includes an SSL Certificate, a security protocol that makes your data travel in an integral and secure way, the transmission of data between a server and a web user and, in feedback, is fully encrypted or encrypted.

We therefore make every effort to protect your personal data, but we cannot fully guarantee the security of the Internet network and therefore the violation of the data transmitted through fraudulent access by third parties. 9- TRANSFERS outside the European Economic Area.

This website uses the services of WordPress and Google Analytics, who can process and transfer data collected through cookies to servers located in the United States, declared a non-secure country by the European Commission, however both companies have articulated as a means of reinforcing security in the transfer of data of European citizens, their commitment in accordance with the standard contractual clauses, which can be consulted in their respective privacy policies, through the links in our Cookies Policy.

10- LINKS to other websites, platforms and social networks

Our website contains links to websites that we consider to be of interest and to social networks.

Truccsa’s Privacy Policy on social networks. The processing of personal data of users who become followers on the social networks of Truccsa‘s official pages will be governed by the provisions of this section; please note that each social network has its own privacy policy and that we are NOT responsible for these policies.

Truccsa may have corporate profiles on social networks such as Facebook, Twitter, Instagram, etc. for the purpose of advertising our products for façade cladding, cement glues and mortars for construction. Users who have a profile may join and become followers of our page on these social networks, thereby showing interest in the information we publish and authorising us to process the personal data published on their profile. Truccsa will process the user’s public information within the social network itself, it will not be incorporated into any file external to it.

Publications on Social Networks. Once linked to our page/profile, the user will be able to publish comments, links, images and any multimedia content supported by the social network. The user must be the owner of the content published and hold the copyright and intellectual property rights or have the authorisation of the third parties affected.. Truccsa reserves the right to immediately remove content that may violate morals, ethics, good taste or violate copyright or intellectual/industrial property rights.

Each user is solely responsible for their privacy on the social network. The contents and images published on the social network will not be stored in any medium by Truccsa but will remain on the social network.

Regarding the exercise of rights you have on the processing of your personal data, in the case of social networks, you should take into account the following nuances: Access: this right will be defined by the functionality of the social network and the ability to access information from user profiles. Rectification: we can only exercise this right with respect to information that is under our control on the social network (e.g. deleting comments posted on our page). Cancellation/Opposition: we may only exercise this right in respect of information under our control, e.g. stop being linked to the profile, stop following us.
